New York’s New Divorce Law

In October 2010, New York became the final state to allow no-fault divorce, making it much easier to get a divorce than in previous years. If either the husband or wife makes a sworn statement that the marriage has been “irretrievably broken” for at least six months before the divorce is filed, then the divorce can be granted.

This means that neither party has to prove fault, which was often the source of much stress and negativity. No longer is it necessary to prove, for example, that a spouse was cheating. In order to obtain the no-fault divorce, all other issues must first be resolved, such as custody, child support, visitation, spousal support, equitable distribution of property and any other issues which may arise.

The other spouse can still contest the divorce by saying that the marriage is not irretrievably broken. If this happens, it would be for the court or a jury to make a decision.
